Terms & Conditions: Try Before You Buy
1. Overview
By participating in the “Try Before You Buy” program, you agree to the terms and conditions outlined below. This program allows you to try a product for 30 days before deciding whether to purchase it. The trial requires an upfront payment covering a refundable deposit and a non-refundable shipping fee. If you choose to return or purchase the product, specific terms regarding costs, refunds, and ownership apply.
2. Free Trial Details
- Trial Duration: 30 days from the date the deposit payment is made.
- Initial Payment: An upfront charge covering:
- Refundable Deposit: €100, refunded under certain conditions.
- Non-Refundable Shipping Fee: €29, covering delivery to the consumer.
- Product Price: Varies by product (payable only if you choose to keep the product).
- Free Return Option: A free return label is included. If you fail to use the return label before it expires, you will bear the cost of return shipping.
3. Billing Terms
- Upfront Payment: At the start of the trial, you will pay a combined charge covering the refundable deposit and non-refundable shipping fee.
- Product Purchase:
- If you decide to keep the product after the trial, you will be charged the product price (as indicated on the product listing).
- The deposit will be deducted from the product price, reducing the final balance due.
- Return Option:
- If you return the product using the included return label within the trial period, no additional shipping costs will apply.
- If the return label is not used before its expiration, you are responsible for covering the cost of return shipping.
4. Ownership of Products
- All products remain the property of Siren Archery until:
- You explicitly choose to purchase the product.
- The full product price (minus the deposit) has been paid in full.
- Failure to return the product within the trial period or failure to complete the purchase after opting to keep the product will result in Siren Archery reserving the right to recover the product and/or charge for damages or the full product price.
5. Conditions for Deposit Refund
The €100 deposit will be refunded within 14 days of returning the product, provided the following conditions are met:
- The product is returned in good condition, free from damage, and includes all original packaging and accessories.
- The free return label is used within its validity period, or the consumer has covered the cost of return shipping.
- You have adhered to the return instructions provided (see Section 6).
If the product is returned damaged, incomplete, or not in its original condition, the deposit refund may be partially or fully withheld to cover repair or replacement costs.
6. Return Process and Consumer Responsibilities
- Free Return Label:
- A free return shipping label will be included with your product shipment. This label can be used to return the product within the trial period at no additional cost.
- The label has an expiration date; if not used before this date, you will be responsible for covering the cost of return shipping.
- Return Deadline:
- You must notify us of your decision to return the product before the 30-day trial period ends.
- Refund Timing:
- Once the product is received in good condition, your €100 deposit will be refunded within 14 days.
- Non-Refundable Fees:
- The initial shipping fee, (€29) is non-refundable.
7. Purchase Process
- If you decide to keep the product after the trial, the full product price (as stated on the product listing) will be charged.
- The €100 deposit will be applied to the product price, reducing your final payment by this amount.
- You must provide explicit consent to proceed with the purchase before any additional charges are applied.
8. Your Right to Withdraw
- 14-Day Withdrawal Period:
- Under EU law, you have the right to withdraw from this agreement within 14 days without providing a reason.
- If you withdraw within 14 days, you must return the product at your own expense (unless the free return label is used). The €100 deposit will be refunded upon receipt of the product in good condition.
- Beyond 14 Days:
- After the 14-day statutory withdrawal period, you can still return the product under the “Try Before You Buy” trial terms until the end of the 30-day period.
9. Communication and Notifications
- Order Confirmation: A confirmation email will be sent at the start of the trial, outlining the trial terms, deposit refund conditions, and your responsibilities for product care and return shipping.
- Trial End Reminder: You will receive a reminder email near the end of the 30-day trial period to confirm whether you would like to return or purchase the product.
- Cancellation Instructions: Clear instructions for canceling the trial and returning the product will be provided in the confirmation email, along with details of the free return label.
10. Compliance with EU and Dutch Law
- Transparency: All charges, including the deposit, shipping fee, and product price, are clearly disclosed before the trial begins.
- Refund Timing: Deposit refunds will be processed within 14 days of receiving the product in good condition.
- Ownership of Products: Products remain the property of Siren Archery until explicitly purchased.
- Data Protection: Your personal data will be handled in accordance with GDPR, and payment details will only be used for authorized transactions.
11. Governing Law
This agreement is governed by Dutch law. In the event of disputes, the competent court in the Netherlands will have jurisdiction.
12. Agreement to Terms By participating in the “Try Before You Buy” program, you acknowledge that you have read, understood, and agreed to these terms and conditions, including the refundable deposit, non-refundable shipping fee, return process, and the fact that products remain the property of Siren Archery unless explicitly purchased.
